INKOSI ALUMINIUM & GLASS
TERMS AND CONDITIONS OF QUOTATION, PAYMENT, MANUFACTURING, SUPPLY AND INSTALLATION
Inkosi Aluminium & Glass | Version 1.0 | Effective: 1 October 2026 | Unauthorised reproduction prohibited.
These Terms and Conditions apply to quotations, orders, manufacturing, supply, delivery and installation services provided by Inkosi Aluminium & Glass (“Inkosi”). By accepting a quotation, paying a deposit or instructing Inkosi to proceed, the client agrees to these Terms and Conditions, subject to applicable South African law.
1. QUOTATIONS AND VALIDITY
1.1. Quotations are valid for 14 calendar days from the date of issue, unless otherwise stated.
1.2. Each quotation is based on the specifications, measurements, materials, finishes, quantities and scope of work stated in it. Work, materials or services not expressly included are excluded and may be quoted separately.
1.3. After the validity period, Inkosi may revise the quotation to reflect changes in supplier pricing, material costs, aluminium profiles, glass, hardware, transport, fuel or other relevant costs.
1.4. If significant and unforeseen external cost increases occur before an order is confirmed, Inkosi may issue a revised quotation. Once a quotation has been accepted, the agreed price will remain in place unless the client requests a change or a price adjustment is otherwise permitted by the accepted agreement and applicable law. Inkosi will communicate proposed adjustments and obtain the client’s agreement where required before proceeding.
2. VAT
2.1. Inkosi Aluminium & Glass is not VAT-registered and does not charge VAT separately while it remains unregistered and is not legally required to account for VAT on the relevant supply.
2.2. The quoted amount is the amount payable for the goods and services specified, subject to the quotation.
2.3. If Inkosi’s VAT status changes, invoicing and any applicable price treatment will be handled in accordance with South African tax legislation and the accepted agreement.
3. DEPOSIT AND PAYMENT
3.1. A 70% deposit is required before an order can be processed, materials purchased or manufacturing commenced.
3.2. The lead time starts only once the deposit has cleared in Inkosi’s bank account and all required measurements, specifications and approvals have been finalised.
3.3. The remaining 30% balance is payable before the goods are released, collected or delivered. Where installation is included, the balance is payable immediately upon completion of the agreed installation, unless another arrangement has been agreed in writing.
3.4. Inkosi does not offer credit facilities or 30-day accounts unless expressly agreed in writing before work begins. Payment must be made in accordance with the accepted quotation.
3.5. Additional work or items outside the original quotation will be charged separately. Inkosi may require payment for additional work before it begins.
3.6. If an amount due is not paid, Inkosi may suspend further work and, where goods have not yet been delivered or installed, withhold their release, delivery or installation until payment is received, subject to the accepted agreement and applicable law. Inkosi may take reasonable lawful steps to recover amounts properly due.
3.7. Where products have already been installed, Inkosi will not remove them without the client’s consent or other lawful authority. The client remains liable for outstanding amounts properly due under the accepted quotation and contract.
4. CANCELLATIONS AND DEPOSIT REFUNDS
4.1. Once the deposit has been received, Inkosi may purchase materials, place supplier orders, prepare for manufacturing and allocate labour or other resources specifically for the order.
4.2. If the client cancels the order, changes their mind or decides not to proceed after paying the deposit, the deposit is non-refundable to the fullest extent permitted by applicable South African law. This applies whether or not manufacturing has started, as Inkosi may already have incurred costs or made commitments for the order.
4.3. If a cancellation or client-requested change results in reasonable costs exceeding the deposit, Inkosi may recover those additional costs where permitted by the accepted agreement and applicable law.
4.4. If Inkosi cannot fulfil an accepted order for reasons attributable to Inkosi, the matter will be addressed in accordance with the accepted agreement and applicable law. Any refund or other remedy legally required will be provided.
4.5. Nothing in this section excludes or limits any cancellation, refund or other rights that cannot lawfully be excluded, including consumer rights under the Consumer Protection Act 68 of 2008 where applicable.
5. LEAD TIME
5.1. The standard estimated lead time is 14 working days. It begins only once the deposit has cleared and all required measurements, specifications and approvals have been finalised.
5.2. Lead times are estimates and may be affected by supplier delays, stock availability, manufacturing requirements, transport disruptions, weather or other circumstances beyond Inkosi’s reasonable control.
5.3. Late payment, client-requested changes, incomplete information, incorrect client-supplied measurements or delayed approvals may extend the lead time.
5.4. Inkosi will communicate material delays to the client as reasonably practicable.
6. SUPPLY ONLY AND INSTALLATION
6.1. Quotations are for supply only unless installation is expressly included in writing. Unless specifically listed, the quotation excludes removal of existing units, building alterations, plastering, painting, tiling, plumbing, electrical or alarm-system work, curtain rails, blinds, finishing and any other work not expressly listed.
6.2. Where installation is included, it is limited to the installation work described in the quotation. Additional work arising from unforeseen site conditions or changes to the agreed scope will be discussed with the client and quoted separately where applicable.
6.3. SUPPLY-ONLY ORDERS — INSTALLATION BY OTHERS
Where Inkosi supplies products on a supply-only basis and the client, a builder, another contractor or any third party installs them, Inkosi cannot guarantee the installation, fitting, alignment, sealing, adjustment or performance of the products as installed.
Inkosi is not responsible for damage, breakage, scratches, incorrect fitting, leaks, operating problems or other issues caused by improper handling, transport after handover, storage, installation or adjustment by others, except to the extent that Inkosi is legally responsible. The client is responsible for arranging installation by a suitably competent installer and for ensuring the products are handled, stored and installed appropriately.
The product warranty described in section 16 remains subject to its terms, any applicable manufacturer’s warranty and South African law. This section does not exclude responsibility for manufacturing defects or any other matter for which Inkosi is legally responsible.
6.4. INSTALLATION-ONLY ORDERS — PRODUCTS SUPPLIED BY OTHERS
Where Inkosi is contracted to install products supplied by the client or another supplier, Inkosi’s responsibility is limited to the installation work specified in the accepted quotation. Inkosi does not provide a product or manufacturing warranty for third-party products. Product-related issues must be referred to the original supplier or manufacturer, subject to applicable law.
Before installation, Inkosi may check for obvious damage, missing components, unsuitable dimensions or other visible concerns. Inkosi will bring identified concerns to the client’s attention and may postpone or decline installation if the products or site are unsafe, unsuitable or not reasonably fit for installation.
Inkosi cannot guarantee the quality, compatibility, dimensions, suitability, condition or performance of third-party products, or that they are free from pre-existing defects. Inkosi is not responsible for defects or damage attributable to the products themselves, except to the extent that Inkosi is legally responsible. Any additional work needed to modify, repair, replace or adapt third-party products will be discussed and quoted separately before proceeding.
Inkosi will take reasonable care when handling and installing third-party products. Nothing in this section excludes responsibility for negligent installation, breach of contract or any liability that cannot lawfully be excluded.
7. MEASUREMENTS AND MANUFACTURING DIMENSIONS
7.1. Where Inkosi measures the site or opening, manufacturing dimensions will be based on the measurements recorded by Inkosi and any subsequently approved specifications.
7.2. If Inkosi has not measured the site, the client is responsible for providing and checking the manufacturing dimensions before production. The client must ensure that the dimensions are accurate and suitable for the intended application, including necessary fitting allowances and clearances.
7.3. The client must verify and approve the relevant dimensions and specifications before manufacturing begins.
7.4. Inkosi is not responsible for additional costs arising from incorrect measurements supplied or approved by the client where the error is attributable to those measurements or approvals.
7.5. Changes requested after manufacturing has begun may result in additional costs, delays or replacement items.
8. ALUMINIUM COLOURS, FINISHES AND SPECIFICATIONS
8.1. The quotation is based on the aluminium colour, finish, profile, glass specification, hardware and other materials stated in it.
8.2. Changes to colour, finish or other specifications may affect the price and lead time. Non-standard colours, powder-coating finishes or options may carry additional supplier or manufacturing costs.
8.3. The client must check and approve the final specifications before manufacturing begins. Any requested change must be recorded and approved in writing by both parties in accordance with section 24. Inkosi will advise of any price or lead-time difference before proceeding.
9. SITE ACCESS, ELECTRICITY AND WATER
9.1. Where installation is included, the client must ensure that the site is accessible, safe and ready for the agreed work.
9.2. Working electricity and water must be available on site where reasonably required for the work.
9.3. The client must arrange access and remove furniture, personal belongings and other obstructions from the immediate work area.
9.4. If the site is not ready, access is restricted or essential services are unavailable, Inkosi may postpone or suspend installation.
9.5. Additional travel, return visits, waiting time or other costs caused by site conditions outside Inkosi’s control will be discussed with the client and may be charged separately where reasonably justified and agreed.
10. EXISTING UNITS, TILES AND SURROUNDING FINISHES
10.1. Removing existing windows, doors, shower enclosures or other fixtures and installing replacements may disturb surrounding tiles, grout, plaster, paint, sealant or other finishes. Existing materials may be brittle, poorly bonded, cracked, weakened or otherwise vulnerable.
10.2. Inkosi will take reasonable care and appropriate precautions. However, it cannot guarantee that existing tiles or surrounding finishes will remain undamaged during removal or installation.
10.3. Inkosi is not responsible for incidental damage to existing tiles, grout or surrounding finishes caused by the reasonable execution of the agreed work, provided the damage is not caused by Inkosi’s negligence, breach of contract or other conduct for which Inkosi is legally responsible.
10.4. The client is responsible for arranging and paying for repairs or replacement of existing finishes where the damage falls within clause 10.3. Any repair work undertaken by Inkosi must be agreed separately.
10.5. Inkosi may notify the client of visibly damaged, loose, cracked or unsuitable existing finishes and discuss the risks before proceeding.
11. SHOWER INSTALLATIONS AND CONCEALED SERVICES
11.1. Installing shower enclosures, glass panels or related fittings may require drilling into tiled walls, floors or other finished surfaces. Inkosi will take reasonable precautions and use suitable installation methods.
11.2. Before drilling or fixing work begins, the client or the client’s appointed contractor must clearly identify and mark the location of any known concealed plumbing pipes, electrical cables, underfloor heating, waterproofing-sensitive areas and other concealed services. The client must also inform Inkosi of known concealed services or special installation restrictions.
11.3. Inkosi is not responsible for damage to concealed services that were not reasonably identifiable and were not disclosed or properly marked, except to the extent that the damage results from negligence or other conduct for which Inkosi is legally responsible.
11.4. Reasonable precautions will be taken to minimise tile damage, but existing tiles may crack or chip during drilling, particularly if brittle, poorly bonded, already damaged or otherwise vulnerable. Inkosi is not responsible for incidental tile damage caused by the reasonable execution of the agreed installation unless attributable to Inkosi’s negligence, breach of contract or other legally actionable conduct.
12. ALARM SYSTEMS AND ELECTRICAL WIRING
12.1. Existing doors and windows may have alarm contacts, sensors, cables or other electrical components fitted to or around them.
12.2. Unless expressly agreed in writing, Inkosi does not disconnect, remove, relocate, reconnect, test or recommission alarm systems or alarm wiring. The client must arrange for a suitably qualified alarm-system contractor to carry out any necessary work before installation or at an agreed time.
12.3. Alarm-system work is excluded from the quotation unless expressly listed. Inkosi is not responsible for faults, damage, disconnection or loss of functionality caused by existing wiring or work performed by third-party contractors, except to the extent that Inkosi is legally responsible.
13. CURTAIN RAILS AND BLINDS
13.1. Inkosi does not remove, reinstall, refit, adjust or relocate curtain rails, curtain tracks or blinds unless expressly agreed in writing.
13.2. The client must arrange for these items to be removed and reinstalled where necessary. Work involving curtain rails, blinds, brackets or associated fittings is excluded unless specifically listed in the quotation.
14. DELIVERY, COLLECTION AND INSPECTION
14.1. Delivery, collection and transport arrangements will be as stated in the accepted quotation or otherwise agreed in writing.
14.2. The client should inspect goods on collection or delivery and notify Inkosi in writing as soon as reasonably possible of visible damage, shortages or discrepancies.
14.3. Inspection at delivery or collection does not remove the client’s statutory rights relating to latent defects, non-conforming goods or other matters protected by law.
15. CLIENT RESPONSIBILITIES AND SITE CONDUCT
15.1. The client must provide accurate information, approved specifications, safe access and any site preparation required for the agreed work.
15.2. Inkosi’s employees and representatives must be treated with courtesy and respect. Abusive, threatening, discriminatory or unsafe behaviour will not be tolerated. If working conditions become unsafe or staff are subjected to threatening or abusive conduct, Inkosi may suspend work until the situation has been addressed.
15.3. Any resulting delays, return visits or additional costs will be discussed with the client and handled in accordance with the accepted agreement and applicable law.
15.4. The client must not instruct Inkosi’s employees to undertake work outside the accepted quotation without prior written approval from Inkosi.
15.5. NO PRIVATE ARRANGEMENTS WITH EMPLOYEES
The client must not directly or indirectly arrange or pay for private or additional work with an Inkosi employee or representative outside the accepted quotation without Inkosi’s prior written approval. Requests for additional work must be directed to Inkosi through its official communication channels and approved in writing before the work begins.
Inkosi is not responsible for agreements, payments, warranties or disputes arising from unauthorised private arrangements between a client and an employee, except to the extent that Inkosi is legally responsible.
16. PRODUCT WARRANTY, WORKMANSHIP AND DEFECTS
16.1. PRODUCT WARRANTY
Inkosi provides a one-year warranty on products supplied by Inkosi, starting from the date of delivery or installation, as applicable. The warranty covers defects in materials or workmanship attributable to the manufacture or supply of the products, subject to this section, any applicable manufacturer’s warranty and South African law.
16.2. WORKMANSHIP WARRANTY
Where Inkosi installs the products, a one-year workmanship warranty applies from practical completion of the installation. It covers defects directly attributable to faulty installation workmanship by Inkosi, subject to this section and applicable law.
16.3. THIRD-PARTY PRODUCTS
Where Inkosi installs products supplied by the client or another supplier, the workmanship warranty applies only to Inkosi’s installation work. Inkosi does not provide a product, material or manufacturing warranty for third-party products. Product-related defects must be referred to the original supplier or manufacturer, subject to applicable law.
16.4. SUPPLY-ONLY ORDERS
Where Inkosi supplies products but another party installs them, the warranty does not cover installation workmanship, fitting, alignment, sealing, adjustment or damage caused by handling, storage, transport after handover or installation by others. The product warranty in clause 16.1 remains subject to its terms and applicable law.
16.5. EXCLUSIONS
The warranties do not cover defects, damage, malfunction or deterioration caused by:
a) Incorrect handling, transport, storage, installation, adjustment or maintenance by the client or a third party;
b) Normal wear and tear, misuse, abuse, accidents, impact damage or neglect;
c) Failure to clean, maintain or operate products with reasonable care or in accordance with the manufacturer’s instructions;
d) Unauthorised repairs, alterations, modifications or adjustments;
e) Building movement, structural defects, unsuitable openings, water ingress from unrelated building defects or site conditions outside the agreed scope;
f) Corrosion, deterioration or damage caused by harsh environmental conditions, chemical exposure or inadequate maintenance, unless expressly covered by the relevant product specification or warranty;
g) External impact, vandalism, third-party actions or events beyond Inkosi’s reasonable control, except where Inkosi is legally responsible; or
h) A condition that existed before installation in products supplied by the client or another supplier.
These exclusions apply only to the extent that the cause is not attributable to a defect in a product supplied by Inkosi, faulty workmanship by Inkosi or another matter for which Inkosi is legally responsible.
16.6. REPORTING A CLAIM
The client must notify Inkosi in writing as soon as reasonably practicable after discovering a suspected defect or workmanship issue. The notice should include the quotation or invoice number, a description of the problem and photographs or other supporting information where reasonably available.
Inkosi must be given a reasonable opportunity to inspect the issue and determine its cause before another party carries out repairs or alterations, except where urgent action is reasonably necessary to protect people or property.
16.7. ASSESSMENT AND REMEDY
If a claim is covered, Inkosi will assess the issue and provide an appropriate repair, replacement or other remedy in accordance with the accepted agreement and applicable law. If the issue is not covered, Inkosi may provide a separate quotation for inspection, repairs, replacement parts or other work. Chargeable work will not proceed without the client’s approval.
16.8. MANUFACTURER WARRANTIES
Any additional manufacturer’s warranty is subject to that manufacturer’s terms, conditions, exclusions and claim procedures. Where applicable, Inkosi will provide available warranty information or reasonable assistance with a claim.
16.9. STATUTORY RIGHTS
Nothing in this section excludes or limits a consumer right, statutory warranty or liability that cannot lawfully be excluded or limited under South African law, including the Consumer Protection Act 68 of 2008 where applicable.
17. OWNERSHIP AND RISK
17.1. To the extent permitted by law, ownership of supplied goods remains with Inkosi until the full amount due has been paid.
17.2. Responsibility for goods during delivery, collection and installation will be determined by the accepted arrangements and applicable law. Once goods have been delivered or left at a site at the client’s request, the client must take reasonable steps to protect them from loss or damage, subject to clause 21 and applicable law.
18. UNFORESEEN CIRCUMSTANCES
18.1. Inkosi will take reasonable steps to fulfil accepted orders within the estimated timeframe.
18.2. If events beyond Inkosi’s reasonable control—such as supplier disruption, material shortages, transport interruptions or extreme weather—cause delays, Inkosi will communicate material delays as reasonably practicable and discuss necessary schedule changes with the client.
19. DISPUTES AND APPLICABLE LAW
19.1. The parties will make reasonable efforts to resolve disputes through written communication and good-faith discussion.
19.2. If a dispute cannot be resolved directly, either party may pursue the remedies available under South African law.
19.3. These Terms and Conditions are governed by the laws of the Republic of South Africa. Nothing in them is intended to exclude or override rights or obligations imposed by applicable legislation, including the Consumer Protection Act 68 of 2008 where applicable.
20. COLLECTION DEADLINES AND STORAGE FEES
20.1. If the client has elected to collect the order, the client must collect it within five working days after Inkosi notifies the client in writing that the order is ready for collection.
20.2. If the order is not collected within that period, a storage fee of R100 per calendar day will apply from the day after the five-working-day period expires until collection or until alternative arrangements are agreed in writing, subject to applicable law.
20.3. Inkosi may offer delivery at an additional cost, subject to the client’s agreement and the availability of delivery services. Any outstanding storage fee or agreed delivery charge must be settled before release or delivery, where legally permitted.
21. SITE SECURITY AND PRODUCTS LEFT ON SITE
21.1. The client must ensure that the delivery or installation site is reasonably secure and that suitable arrangements are in place to protect products, materials, tools and equipment left there.
21.2. If products are delivered or left at an unsecured, unoccupied or otherwise vulnerable property, the client acknowledges the risk of loss or theft after delivery or placement at the site.
21.3. Inkosi is not responsible for products lost or stolen because of inadequate site security, unauthorised access or circumstances beyond its reasonable control, except to the extent that the loss results from Inkosi’s negligence, breach of contract or other conduct for which it is legally responsible.
21.4. The client must advise Inkosi of security concerns before delivery or installation. Where reasonably necessary, Inkosi may request suitable security arrangements before products are delivered or left on site.
22. REMOVAL AND DISPOSAL OF EXISTING WINDOWS AND DOORS
22.1. If removal of existing windows, doors or frames is included in the quotation, the removed items will be taken away and discarded unless an alternative arrangement is agreed in writing before work begins.
22.2. If the client wishes to retain any removed windows, doors, frames, glass or associated materials, this must be agreed in writing in advance. The client must identify the items to be retained before removal begins.
22.3. Inkosi does not guarantee that removed products will remain intact, undamaged or suitable for reuse. Removal may involve cutting, dismantling or breakage, and may damage existing frames, glass, fittings, sealants or surrounding materials. Inkosi will take reasonable care, but preservation for reuse cannot be guaranteed.
22.4. Requests for careful removal intended to preserve products for reuse must be discussed before the quotation is accepted and may involve additional labour, time and costs.
23. ACCEPTANCE OF TERMS
23.1. Acceptance of a quotation, payment of the deposit or written instruction to proceed constitutes acceptance of these Terms and Conditions, subject to applicable law.
23.2. The accepted quotation, any written order confirmation and these Terms and Conditions must be read together. If a special arrangement is agreed, it must be recorded in writing in accordance with section 24.
24. CHANGES, VARIATIONS AND WRITTEN APPROVAL
24.1. Changes to an accepted quotation or order—including changes to measurements, manufacturing sizes, quantities, pricing, site conditions, glass type or colour, aluminium colour or finish, hardware, installation requirements, delivery arrangements or scope of work—must be documented and approved in writing by both Inkosi and the client before they are implemented.
24.2. Verbal instructions or conversations do not, by themselves, constitute formal approval of a change. Any WhatsApp message, email or other electronic communication relied on as approval must clearly identify the agreed change and be attributable to the relevant party.
24.3. An agreed variation must be recorded in a revised quotation, written variation order or other written document identifying the change and any price or lead-time adjustment.
24.4. Inkosi is not required to proceed with a change until the variation has been approved in writing by both parties and any required additional payment has been received.
24.5. If a change affects materials already purchased or manufacturing already commenced or completed, the client may be responsible for reasonable additional costs, including wasted materials, supplier charges, remanufacturing and additional labour, subject to the accepted agreement and applicable law.
24.6. If there is a discrepancy between informal discussions and the latest mutually approved written quotation or variation, the latest approved written document will record the agreed specifications and scope, subject to applicable law.
24.7. Electronic documents and signatures may be used to record written approval where the approval is clear, attributable to the relevant party and legally valid.
25. BUSINESS STRUCTURE AND OPERATING MODEL
25.1 Inkosi Aluminium & Glass operates as a sole proprietorship under the ownership and management of one proprietor. The business operates on a flexible, project-based model designed to serve customers efficiently within the private sector.
25.2 As a small business, Inkosi Aluminium & Glass does not operate with the same permanent staffing structure, administrative capacity or resources as a large company. The business model therefore makes use of independent contractors, casual workers, outsourced service providers and other independent businesses where appropriate to the requirements of a particular project.
25.3 This operating model enables Inkosi Aluminium & Glass to manage its costs, remain flexible, respond to customer requirements and provide opportunities for other sole proprietors, independent service providers and small businesses to participate in commercial activity.
25.4 The use of independent service providers or external businesses does not, by itself, establish an employment relationship with Inkosi Aluminium & Glass. The nature of each engagement will depend on the actual arrangement, the work performed and applicable law.
25.5 The scope of work, pricing, responsibilities and deliverables applicable to each project will be determined by the accepted quotation, these Terms & Conditions and any written variations agreed between the relevant parties.
26. EXTERNAL SALES SOURCING AND BUSINESS REFERRALS
26.1 Inkosi Aluminium & Glass may work with external sales sourcers, independent business introducers or other external parties who identify potential customers, source business opportunities or facilitate the introduction of projects to the business.
26.2 These arrangements are agreed separately between Inkosi Aluminium & Glass and the relevant external party. Where applicable, the external party may receive an agreed portion of the commercial value associated with the business opportunity or project, in accordance with the specific arrangement between the parties.
26.3 These arrangements form part of the business's external sourcing and collaborative operating model and are not intended to constitute a standard employee commission structure. The applicable payment, allocation or fee arrangement is determined by the agreement between Inkosi Aluminium & Glass and the external party concerned.
26.4 Unless expressly agreed otherwise in writing, external sales sourcers and business introducers are not authorised to amend Inkosi Aluminium & Glass quotations, vary contractual terms, make binding promises on behalf of the business or commit the business to additional work, discounts or expenditure.
26.5 Once a sourced opportunity has been accepted by Inkosi Aluminium & Glass, the business will undertake the work in accordance with the agreed quotation and contractual arrangements. The customer's payment obligations remain those specified in the accepted quotation and these Terms & Conditions, unless otherwise agreed in writing.
26.6 Any arrangement between Inkosi Aluminium & Glass and an external sales sourcer, introducer or other independent party is separate from the customer's agreement with Inkosi Aluminium & Glass. Such an arrangement does not alter the customer's agreed price, scope of work, payment obligations or applicable consumer rights unless a change is expressly agreed in writing.
27. SITE COMPLIANCE, HEALTH AND SAFETY REQUIREMENTS
27.1 The customer must inform Inkosi Aluminium & Glass, before accepting a quotation or confirming a project, of any site-specific health and safety requirements or access conditions that may affect the work. These may include safety files, medical fitness certificates, inductions, permits, registrations, contractor documentation and other requirements imposed by a site owner, client, principal contractor or applicable legislation.
27.2 Inkosi Aluminium & Glass's standard quotations exclude the preparation, procurement, administration and cost of client-specific compliance documentation and third-party compliance services unless expressly included in the quotation or separately agreed in writing.
27.3 Where site-specific compliance requirements apply, the parties must establish in advance which requirements are to be arranged by the customer, site owner, principal contractor, Inkosi Aluminium & Glass or any relevant independent service provider. The allocation of responsibilities and any additional costs must be agreed in writing before the affected work commences.
27.4 The customer must provide relevant site rules, specifications, documentation requirements and access procedures sufficiently in advance to allow the parties to assess the requirements and agree on the necessary arrangements.
27.5 Where requirements are disclosed only after the quotation has been accepted, or where additional requirements arise that were not reasonably included in the original quotation, any additional costs, administrative work, delays or return visits may be quoted separately and must be agreed in writing before the additional work or expense is incurred.
27.6 Inkosi Aluminium & Glass reserves the right to postpone or decline commencement of work where required site access, approvals, information or safety arrangements have not been confirmed, or where proceeding would be unsafe or unlawful. Any resulting changes to the project schedule or additional costs will be addressed in accordance with the accepted quotation, these Terms & Conditions and applicable law.
27.7 Nothing in this clause excludes or transfers any statutory health and safety obligation that legally rests with Inkosi Aluminium & Glass, its contractors or any other party. Each party remains responsible for complying with the legal duties applicable to its role and activities on the site.
28. BUSINESS OWNERSHIP AND B-BBEE STATUS
Inkosi Aluminium & Glass operates as a sole proprietorship owned and managed by one proprietor. The business is 100% white male-owned and has an annual turnover of less than R10 million.
Based on the applicable turnover threshold and subject to confirmation under the relevant B-BBEE Codes of Good Practice, Inkosi Aluminium & Glass is classified as an Exempted Micro-Enterprise (EME) with
Level 4 B-BBEE recognition.
Inkosi Aluminium & Glass operates as an independent small business specialising primarily in the manufacture and supply of aluminium products, with related installation services provided where required.
Where requested, supporting B-BBEE documentation will be provided in accordance with the applicable requirements and the business's confirmed classification.
